「零」投資移民英國方案：駐外首席代表移民簽證詳解

隨著海外公司首席代表簽證曝光率的提高，此類簽證普遍被高資產、高素質人群認為是最經濟的移民英國途徑。相比較於大家已經比較熟悉的投資移民和企業家移民來說，前二者的門檻較高，且資金投入較大。

海外首席代表可以說是零成本的一種移民途徑。但此類簽證對於申請人所在公司的經營情況和申請人自身的資質要求較高。大叔根據多年從業經驗，以及對移民法的深入了解，成功幫助多名客戶走出申請海外首席代表簽證誤區，實現夢想。

在這裡，大叔總結了此類簽證的基本要求，申請所需的材料，以及一些需要注意的事項，供有需要的讀者參考。

本要求

對申請者要求

a. Must come from outside the EEA 申請者必須來自於EEA境外，且只能在境外遞交申請 （不少在英申請者希望轉為此類簽證實現移民目的，但大部分在英人群不符合以下幾點條件）

b. Not a majority shareholder 不能是公司主要股東 （移民局的規定是不能持有公司50%股份，但根據實戰經驗來看，一般不建議持股超過20%）

c. Employed directly by the company outside the UK 在英國境外直接受雇於公司，即作為銷售代理或與公司簽訂代理合同的第三方均不符合條件

d. Has been a senior employee for at least 2 years 在公司至少有兩年以上高管經驗

e. Being familiar with the company』s business 熟悉公司業務

f. English Language ability A1 英語語言達到基本交流水平

g. Sufficient maintenance funds 有足夠在英維生資金（主申請人有不少於3310英鎊在個人銀行賬戶存期連續90天）

對申請者就職公司的要求

a. Trading and centred outside the UK 公司總部需位於英國境外並保持在英國境外，保持交易 （新成立不久的公司及欲將總部移到海外的公司不符合要求）

b. Has no other branch or subsidiary in the UK 公司在英無其他代表處或子公司

c. Has no other previous representatives in the UK 公司在英無其他首席代表

根據申請者自身情況，可能會需要提供不同的材料，但一般都可按照此清單上的要求來準備：

1. Application form, completed and signed 填寫完整並簽名的申請表

2. 2 x passport sized photos 2張護照規格的照片

4. Household registration book and translation 戶口本及翻譯件

5. English Language 證明申請人英文水平達到A1水準

5. Mx. xxxxxx has been appointed as the sole representative of xxxxxx Co., Ltd in establishing and operating a registered branch in the UK.

6. Mx. xxxxxx is fully familiar with xxxxxxx Co., Ltd』s activities and has full powers to negotiate and take operational decisions without reference to the xxxx headquarter for the purpose of representing the company in the UK.

7. Mx. xxxxx will be working full-time for xxxxxx Co., Ltd during his/er stay in the UK as the sole representative of the company. Mx. xxxxx will be based mainly in the UK and working on a UK long-term assignment and will not engage in business of his/er own nor will s/he represent any other company』s interest.

關於續簽

符合簽證申請條件者，可申請並獲簽3年有效簽證。3年之後，若滿足以下條件，即可續簽2年簽證：

　　1)申請者仍為同一所海外公司工作；

　　2)此海外公司的總部仍在英國境外，並仍在境外進行交易。

3)5年期滿後，則可申請英國永居。

需要注意的是，在持有海外公司首席代表簽證的5年期間，申請者只能為同一所海外公司全職工作，不可以自己創業或代表其他任何一家公司。且5年期滿後申請永居，也必須滿足每年離境不超過180天的條件。

關於面試：

一般來說，首席代表簽證並無面試要求，但也不排除申請者被抽查前往移民局面試或接受電話面試的可能性。若被抽中面試也無需緊張，筆者建議申請者把握首席代表簽證的兩個核心：1. 申請者具有業內資質，完全了解公司情況並有權代公司進行決策；2. 公司有真實必要擴展英國市場的需求。所有的問題都將圍繞這兩個核心展開。

關於公司經營狀況：

對於申請者任職的公司而言，除滿足之前提到的條件以外，最重要的一點是「如何證明公司是真實有擴展英國市場的需求」。因此在申請中，提供一份詳細的商業計劃也是必不可少的，內容包括：公司業務範圍，現有客戶群體，發展方向，英國市場前景，現有英國資源，以及經營策略等。

移民局對此項要求並沒有設定量化條款，然而根據筆者經驗，公司的年營業額最好能達到500萬人民幣。因此，首代簽證較為適合那些發展中的、看準海外尤其是英國市場的中型企業；小型企業營業額很難達到標準，不足以證明擴展英國市場的必要；而大型企業（例如國企）一般已有英國代表處、子公司，無法滿足基本申請條件。

因此申請之前，建議諮詢專業人士，對自身情況進行詳細評估分析，以提高申請成功率。
