2. 「形式為」這裡是法律規定，而非一般的現象描述。因此，這裡應該翻譯為：shall take the form of。

故此，這裡應該修改為：

原文：合營企業的有關外匯事宜，應遵照中華人民共和國外匯管理條例辦理。

參考譯文：An equity joint venture handles its foreign exchange transactions according to Regulations on Foreign Exchange Control of the Peoples Republic of China.

分析：這裡和上一句是同樣的問題。「應遵照」這裡應該使用shall；此外，according to在法律條款和合同中，一般都用in accordance with。

分析：

1. 和上一句同樣的問題，「應遵守」翻譯漏了。

2. 這句話的對象是「一切活動」，主語改為「an equity joint venture」導致信息中心出現了偏移。其實，這裡根本無需更換主語，就可以翻譯的非常地道。

建議修改為：All activities of an equity joint venture shall comply with the provisions of the laws, decrees and pertinent regulations of the Peoples Republic of China.

原文：合營企業所需原材料、燃料、配套件等，應儘先在中國購買，也可由合營企業自籌外匯，直接在國際市場上購買。

參考譯文：In the purchase of raw materials, fuels and auxiliary equipment and so on, an equity joint venture gives first priority to purchasing them in China. It may make purchases of them directly on the international market with foreign exchange raised by itself.

分析

1. 「應儘先在」這裡需要翻譯為shall...。

2. purchasing them, make purchases of them，with xxx raised by itself表述略顯尷尬，需要修改。

建議修改為：

In the purchase of raw materials, fuels and auxiliary equipment and so on, an equity joint venture shall give priority to purchasing them in China, but may also make purchases directly on the international market with its own foreign exchange funds.

參考譯文中，「...中國的仲裁機構...」直接翻譯成了Chinas arbitration agency，此處為錯誤。中國的仲裁機構不止一家，不能這麼簡單處理。建議修改為 an arbitral body in China。

原文：鼓勵外國合營者將可匯出的外匯存入中國銀行。

參考譯文：A foreign side is encouraged to deposit its foreign exchange which was entitled to remit abroad in Bank of China.

分析：

1. which was，這裡居然出現了一般過去時。嚴重差評。

2. which it was entitled to remit abroad，定語從句漏掉了主語。嚴重差評。

3. 協議/合同各方，最常用的詞語是party，而不是side。

建議修改為：A foreign party is encouraged to deposit in Bank of China all foreign exchanges which it is entitled to remit abroad.

在deposit後面緊跟in Bank of China，防止中間插入內容過長，導致閱讀理解困難。

總體來說，作為講述「主語轉換」的一章，這裡選取的很多句子並不適合換主語。而且，最重要的是，選擇了一篇法律條文中的句型，卻沒有去研究法律翻譯的問題風格以及要求，這樣對學生是不負責任的。

短短一章，無法做到面面俱到，但最起碼時態、情態動詞的用法，要捎帶著解釋一下吧？
