這時法律上選舉並未結束，兩人不算正式當選，依然只是普通候選人。兩人死亡的話，選舉人可以改投他人，然後選舉流程照舊。最終如果某個候選人得到選舉人票過半，則自動當選；如果沒有選舉人得票過半，則由眾議院從得選舉人票最高的三中選舉總統。這裡的一個變數是國會有權決定是否作廢那些依然投給已經死亡的當選總統和副總統的選舉人票。而由於選舉人票過半數的要求只針對有效票而言，這樣一來過半數所需要的票數就會降低。在有足夠多的廢票的前提下，當選總統和副總統和競爭對手有可能直接得選舉人票過半而自動當選

2、當選總統和副總統在選舉人團投票之後和就職之前死亡：

這時按照《總統繼承法》，兩人死亡和正式的總統和副總統死亡一樣，由法定總統順位繼承名單上的人繼位代理總統並完成整個任期。就現狀而言，就是由眾議院議長Paul Ryan繼位總統，然後再由他提名副總統。

問題二：

沒有合法的方式。舉例來說，歷史上在二戰依然如火如荼的1944年，該總統大選依然大選。
