second degree murder和voluntary manslaughter有何區別？

在英美法律體系中，first degree murder, second degree murder（一級謀殺二級謀殺）和voluntary manslaughter，involuntary manslaughter在概念上是同級的嗎？2nd degree murder和voluntary manslaughter有何區別？四者的概念是什麼？可以舉出具體的例子嗎？

First-degree murder：比如我現在想著我要殺了你，然後我朝著你的太陽穴開了一槍，你死了，這個就成立了。最高判life imprisonment或者death penalty。

（不等於Felony Murder，但是在特定的情況下Felony Murder 可以按照First degree來起訴－Felony Murder Rule）

Second-degree murder:

1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender"s obvious lack of concern for human life.

比上一個要輕一些，屬於介於First degree和voluntary manslaughter之間的一個概念。比如說澳大利亞有一個case，說的是一個丈夫（好像是因為和妻子生氣吧）把自己還是嬰兒的小孩從抱起來砸到地面上了。這樣的情況下這肯定是一個『dangerous conduct』，『obvious lack of concern for human life』也是滿足的－因為一個reasonable person應該知道，把一個小孩從空中砸下來他一定會死，但是這個情況下的sudden heat of passion一定不是reasonable的。最高判life imprisonment。

Voluntary manslaughter:

和上一情況類似，只是這種情況下的sudden heat of passion 是reasonable的。沒有prior intention，是因為對方或是第三方的provoke才產生的瞬間的殺意。最高判15年。

Involuntary manslaughter:

並沒有intention去殺了這個人。比如說有一個人站在湖邊，你站在這個人的後面，我推了你一把，你沒站穩扶了一下前面的人把他推下湖了。或者你在夢遊的時候殺了人。這種情況的defence一般是lack of will, automatism之類的。 8到15年。

Murder是要有預謀的，美國一般murder都要15到20年最低刑期。一級謀殺是謀財等幾種動機非常惡劣的情況。manslaughter就是殺人，不需要預謀，可以是Heat of passion，有主觀故意是voluntary。重大疏忽致人死亡一般是involuntary man slaughter

Second degree murder is intentional or as a result of a heinous crime as arson or rape. Voluntary manslaughter is a murder where the perpetrator had no prior intent, but acted under the influence of emotions.
